PERSONAL DATA PROTECTION NOTICE (PDP)<\/span><\/b><\/h2>

This notice serves to inform you of the manner in which your personal data is collected, processed, stored, disclosed, and protected in accordance with the Personal Data Protection Act 2010 [Act 709]<\/b>.<\/span><\/p>

1.\u00a0TYPES OF PERSONAL DATA COLLECTED<\/span><\/b><\/p>

Personal Data Protection Department (JPDP) collects various types of personal data from you in order to fulfil its regulatory and enforcement functions under Act 709, including but not limited to:<\/span>\u00a0<\/span><\/p>

a) <\/span>personal identification information such as full name, date of birth, gender, identification card\/passport number and marital status;<\/span>\u00a0<\/span><\/p>

b)<\/span>\u00a0<\/span><\/span>contact information such as residential address, telephone number and email address;<\/span>\u00a0<\/span><\/p>

c)\u00a0\u00a0\u00a0 <\/span><\/span>financial or payment-related information;<\/span>\u00a0<\/span><\/p>

d)\u00a0\u00a0\u00a0 <\/span><\/span>employment or business-related information such as company registration number and business sector;<\/span>\u00a0<\/span><\/p>

e)\u00a0 \u00a0 <\/span><\/span>technical information such as IP address from online\u00a0interactions;<\/span><\/p>

f)\u00a0\u00a0\u00a0\u00a0 <\/span><\/span>other information necessary for the performance of JPDP\u2019s regulatory and enforcement duties.<\/span><\/p>

\u00a0<\/span><\/p>

Failure to provide the required data may affect the effectiveness of JPDP in discharging its responsibilities under Act 709.<\/span><\/p>

\u00a0<\/span>\u00a0<\/span><\/p>

2.\u00a0PURPOSES OF PERSONAL DATA COLLECTION AND PROCESSING<\/span><\/b><\/p>

\u00a0<\/span>The personal data collected will be processed for the following purposes:<\/span>\u00a0<\/span><\/p>

a)\u00a0\u00a0\u00a0 <\/span><\/span>processing registration applications for Data Controllers;<\/span>\u00a0<\/span><\/p>

b)\u00a0\u00a0\u00a0 <\/span><\/span>handling complaints and investigations of violations under Act 709;<\/span>\u00a0<\/span><\/p>

c)\u00a0\u00a0\u00a0 <\/span><\/span>conducting inspections and monitoring compliance;<\/span>\u00a0<\/span><\/p>

d)\u00a0\u00a0\u00a0 <\/span><\/span>disseminating information, advocacy, training and public awareness campaigns related to personal data protection;<\/span>\u00a0<\/span><\/p>

e)\u00a0\u00a0\u00a0 <\/span><\/span>engaging in official communication with you via letters, emails or telephone calls;<\/span>\u00a0<\/span><\/p>

f)\u00a0\u00a0\u00a0\u00a0 <\/span><\/span>providing customer service and internal administrative management;<\/span>\u00a0<\/span><\/p>

g)\u00a0\u00a0\u00a0 <\/span><\/span>fulfilling legal and regulatory obligations;<\/span>\u00a0<\/span><\/p>

h)\u00a0\u00a0\u00a0 <\/span><\/span>conducting research, policy evaluation, and statistical analysis.<\/span><\/p>

3.\u00a0SOURCES OF DATA COLLECTION<\/span><\/b><\/p>

\u00a0<\/span>JPDP collects your personal data through direct or indirect interactions, including but not limited to:<\/span>\u00a0<\/span><\/p>

a)\u00a0\u00a0\u00a0 <\/span><\/span>information you provide to JPDP via forms, emails, or physical meetings;<\/span>\u00a0<\/span><\/p>

b)\u00a0\u00a0\u00a0 <\/span><\/span>participation in surveys, public consultation papers, or JPDP organised programmes\/activities;<\/span>\u00a0<\/span><\/p>

c)\u00a0\u00a0\u00a0 <\/span><\/span>usage of JPDP\u2019s website or digital platforms.<\/span><\/p>

4.\u00a0SECURITY OF PERSONAL DATA<\/span><\/b>\u00a0<\/span><\/b><\/p>

JPDP is committed to ensuring the secure storage of your personal data. Technical and organisational security measures are implemented to protect your data from loss, misuse, alteration, unauthorised access or disclosure. Only authorised individuals are allowed access to the data and regular security audits are conducted.<\/span><\/p>

5.\u00a0RETENTION OF PERSONAL DATA<\/span><\/b><\/p>

Your personal data will only be retained for as long as necessary to fulfil the purposes for which it was collected or as required by law. Upon the expiry of the retention period or when the data is no longer required, it will be permanently destroyed.<\/span><\/p>

6.\u00a0DISCLOSURE OF PERSONAL DATA<\/span><\/b><\/p>

Personal data processed by JPDP will not be shared with any other party unless such disclosure is permitted under Section 39 of Act 709. Your personal data will only be processed for the purposes stated above and may be disclosed to:<\/span><\/p>

\u00a0<\/span><\/p>

a)\u00a0\u00a0\u00a0 <\/span><\/span>external service providers appointed by JPDP for the provision of technology services, support, and online payment systems;<\/span>\u00a0<\/span><\/p>

b)\u00a0\u00a0\u00a0 <\/span><\/span>public authorities or regulatory bodies as permitted or required by law.<\/span><\/p>

7.\u00a0\u00a0YOUR RIGHTS AS A DATA SUBJECT<\/span><\/b><\/p>

Under Act 709, you are entitled to the following rights:<\/span>\u00a0<\/span><\/p>

a)\u00a0\u00a0\u00a0 <\/span><\/span>Right of Access<\/span><\/b> \u2013 You have the right to request a copy of your personal data held by JPDP.<\/span>\u00a0<\/span><\/p>

b)\u00a0\u00a0\u00a0 <\/span><\/span>Right to Correction<\/span><\/b> \u2013 You have the right to request that JPDP correct any inaccurate, incomplete, or outdated personal data.<\/span><\/p>

c)\u00a0\u00a0\u00a0 <\/span><\/span>Right to Withdraw Consent<\/span><\/b> \u2013 You have the right to withdraw your consent for the processing of your personal data, subject to applicable laws. However, this may affect JPDP\u2019s ability to fulfil its obligations to you.<\/span><\/p>

d)\u00a0\u00a0\u00a0 <\/span><\/span>Right to Prevent Processing<\/span><\/b> \u2013 You have the right to request that JPDP stop processing your personal data for a specific purpose.<\/span><\/p>

e)\u00a0\u00a0\u00a0 <\/span><\/span>Right to Data Portability<\/span><\/b> \u2013 You have the right to request that JPDP transfer the personal data you have provided to another organisation.<\/span><\/p>

8.\u00a0USE OF COOKIES<\/span><\/b><\/p>

JPDP\u2019s websites and digital platforms may use cookies to enhance user experience.
